		<description>The distinction to make always hinges on a persons intent. As in:  did the person with HIV  have unsafe sex with the intention of infecting their partner. And negligence is part of that. As in did they just, NOT care.
Because if so, than that is who the law should be targeting. People who engage recklessly in unsafe sex.
The law needs to be clear, so that a simply  case of lack of communication between lovers in the heat of the moment does not become a criminal offense for the person with HIV.
I personally don&#039;t see how a HIV person, engaging in sex with a condom can every be prosecuted for instance? Yet under the current law in Australia that is possible.</description>
