Courts to rule on first Canadian same-sex divorce

A lesbian couple could become the first Canadian same-sex divorcees since marriage became legal just over a year ago.

According to The Advocate the women were married a week after Canadian courts legalized same-sex marriage. They broke up five days later.

Divorce legislation in Canada does not recognize same-sex couples, defining “spouse” as “a man or woman who are married to each other”.

The divorce will be heard in court on Monday 13 September.
