A Hong Kong court has confirmed a ban on transgender people marrying their opposite sex partners
“Ms W” has been given an ID card and other documentation that recognises her as a woman, but the Hong Kong Government has refused to let her alter her birth certificate or marry her male partner.
Ms W began a court challenge to the ban in 2010 which Hong Kong’s Court of Appeal has now confirmed a second time – finding that the definition of two persons of the opposite sex in the territory’s Marriage Ordinance excluded transgender persons with opposite sex partners.
Judges indicated that it was up to lawmakers to change the law, but the case will now go to the territory’s Court of Final Appeal.
