
Federal judge strikes down same-sex marriage ban in Utah


REPORTS are emerging from the USA that a federal judge has ruled that the state-based marriage laws are “unconstitutional” and despite the expected controversy, he did not put a stay on his decision pending an appeal.
Chris Johnson, Chief Political and White House Reporter from the Washington Blade reports: “A federal judge in Utah has ruled the state’s constitutional ban on same-sex nuptials is unconstitutional, enabling gay couples in the state to apply for marriage licenses immediately.
“U.S. District Judge Robert Shelby, an Obama appointee, issued 53-page decision on Friday, determining the state’s ban on same-sex marriage violates gay couples’ rights under the 14th Amendment of the U.S. Constitution.”
In his judgement, Shelby stated: “Applying the law as it is required to do, the court holds that Utah’s prohibition on same- sex marriage conflicts with the United States Constitution’s guarantees of equal protection and due process under the law.
“The State’s current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason. Accordingly, the court finds that these laws are unconstitutional.”

The Blades’ Michael Lavers told the Star Observer that he expected the case to be appealed despite the judgement not being stayed.
Within a short time his prediction was correct, as he later advised that: “the (Utah) Governor just filed a request for an emergency stay”. Lavers also confirmed “17 states and D.C. currently allow same-sex marriage.” The latest state was New-Mexico showing momentum is gaining in the U.S. for state-based marriage equality.

He also hurried people after appearing to learn of the Governor’s emergency stay intervention posting the following tweet:
