CityRail employee cleared of gay sexual harassment charges

Patrick Breen, a CityRail employee accused of sexually assaulting a male trainee, has been acquitted of all charges following a hearing before the Transport Appeal Board.

Claims that Breen had inappropriately touched a trainee, Daniel Dibella, were disproved.

Board chairman John Parkin not only denied Dibella’s version of events but went on to make recommendations that he be disciplined for making such malicious statements.

Dibella claimed that Breen had touched him on the leg and back and said that he was randy. These allegations led to Breen’s demotion from guard trainer to the position of train guard.

Witnesses who testified at the hearing contested this version of events, stating that Breen had simply been trying to wake Dibella who had fallen asleep on the job.

Breen, a CityRail employee for 42 years, will be re-instated as a guard trainer.
